Terms of use
International Students SAFETYCard (“SAFETYCard”) is the national safety program of National Liaison Committee For International Students Limited ABN 69 130 679 864 (“NLC”), the national peak body for International Students in Australia, jointly supported by Australian Police and Multicultural Community to create the national safety network for International Students Community.
SAFETYCard is administered by NLC and distributed by NLCampus Representatives and International Students Clubs affiliated under the SAFETYCard program. All International Students are entitled to apply for membership free of charge.
The terms and conditions set out below apply to the provision to you by NLC of SAFETYCard membership. SAFETYCard and all related trademarks and logos remain the property of NLC, and may not be copied, imitated, or used, in whole or in part, without the prior written permission of NLC.
If you have any questions in relation to SAFETYCard or the Terms and Conditions set out below please contact NLC.
1. Eligibility
1.1 In order to become a SAFETYCard Member, you must be a non-Australian Permanent Resident or Citizen, and intending to be or currently enrolled in an Australian educational institution.
1.2 By using the Site, you represent and warrant that
(a) all registration information you submit is truthful and accurate;
(b) you will maintain the accuracy of such information;
(c) you are an International Student (being a full-fee paying student who is a foreign national and enrolled in an Australian educational institution. If you are under 18 years of age, you must receive consent from your parent or guardian to be eligible to become a Member. Your profile may be deleted and your membership may be terminated without warning, if we believe that you are not an International Student.
1.3 NLC reserves the right to request certain documentation and/or
information from you in order to verify your International Student
status.
2. Termination
2.1 SAFETYCard Members are to make safety incident reports truthfully and honestly. Misuse of safety services may result in the cancellation of membership.
2.2 NLC reserves the right to cancel any membership where incorrect or fraudulent information is provided.
2.3 You may terminate your SAFETYCard membership at any time for any reason. NLC reserves the right to immediately, without notice or reason, suspend or terminate your access to the service or your membership.
2.4 NLC reserves the right to reverse all such transactions and to terminate any accounts that are associated with any behaviour contrary to the purpose and integrity of the SAFETYCard Program;
3. The Site
3.1 The website located at the URL: www.safetycard.org.au (“Site”) and provided by NLC.
4. Membership
4.1 By registering with SAFETYCard you become a member of the service (“Member”) and agree to be bound by these Terms and Conditions. As a member of this Site, these Terms and Conditions represent the agreement between you and NLC. Your continued use of the Site and any services offered through the Site constitutes your acceptance of these Terms and Conditions.
4.2 Your SAFETYCard membership is for your sole, personal use only. You may not authorise others to use your membership, and you may not in any way transfer or assign your membership to any other person or entity.
4.3 NLC reserves the right to take measures to ensure the integrity of its database, and it is the SAFETYCard Members’ responsibility to keep his/her information and details up to date, so that they will be able to be promptly assisted in the event of a safety-related incident.
4.4 SAFETYCard membership allows you to benefit from discounts on certain products and services. The discounts available to you and the organisations providing such benefits are not fixed and may vary or be withdrawn at any time.
4.5 If you choose to deal with an organisation that provides SAFETYCard Members with discounted goods or services then it is your responsibility to ensure that you are comfortable with the terms upon which such organisations are offering such goods and services.
5. Changes to Terms
5.1 Changes to these Terms and Conditions are subject to change by NLC at any time. You will be notified of these changes and they will appear on the Terms and Conditions page. Your continued use of the Site constitutes to your acceptance of the amended Terms and Conditions.
6. Indemnification
6.1 You agree to defend, indemnify, and hold harmless NLC, its employees, agents, representatives, officers, directors and third parties, for any losses, costs, liabilities, damages to or actions and /or claims against safetycard.org.au and expenses (including legal fees) relating to or arising out of your use of the Service, including any breach by you of the terms of this Agreement.
7. Member Conduct
7.1 As a Member, you agree:
7.1.1 that you are solely and entirely responsible for any content or information you transmit or otherwise communicate to other SAFETYCard Members;
7.1.2 that you will not transmit or otherwise communicate to other SAFETYCard Members or NLC employees, any defamatory, inaccurate, harassing, threatening, racist, abusive, obscene, profane, illegal or offensive sexually-oriented material, or any material that violates or infringes another party's rights (including, but not limited to, rights of privacy and publicity, and intellectual property rights);
7.1.3 to use the Service in a manner consistent with any and all applicable laws and regulations;
7.1.4 not to post, distribute or reproduce or communicate in any way any copyrighted material, trademarks, or other proprietary information without obtaining full, valid and verifiable prior consent of the owner of such proprietary rights; and
7.1.5 not to disrupt, modify or interfere with the Service or its associated software, hardware and servers in any way, and you agree not to impede or interfere with the other users of the Service. You also agree not to alter or tamper with any information or materials on, or associated with, the Service.

9. Disclaimer of Warranty
9.1 You acknowledge that you are using the Site and Service entirely at your own risk.
9.2 NLC provides the Site and Service on an "as is" basis and grants no warranties of any kind - express, implied or statutory - in any communication with NLC or its representatives, or otherwise with respect to the Site or Service. NLC specifically disclaims any implied warranties of fitness for a particular purpose, merchantability or non-infringement.
9.3 NLC does not warrant that your use of the Site will be secure, always available, uninterrupted, or error-free or that their will be no loss of transmitted information or will meet your requirements, or that any defects in the Site will be corrected, or that no viruses or malicious program code will be transmitted on the service.
9.4 Specifically, NLC are not liable to you for:
9.4.1 errors, inaccuracies, failures or omissions in the Site, or linked sites on the Web;
9.4.2 delays to, interruptions of or cessation of the services provided in or on the Site, or linked sites; and
9.4.3 defamatory, offensive (including in relation to age, sex or race) or any illegal conduct of any user of the Site, whether caused through our negligence, our employees or independent contractors we use, or through any other cause. You agree to accept the full cost of any necessary repair, correction and maintenance of any of your computer software or hardware, which may be necessary as a consequence of you accessing the Site or using materials from the Site.
9.5 To the maximum extent permitted by law, we do not accept any liability for any damage, harm, loss or expenses suffered by any use, viewing, or any other utilisation of this Site. Such damage, harm, loss or expenses include (but are not limited to) those occurring through business use (for example, loss of data or profits), viewing, or any other utilisation of this Site.
9.6 When a person uses, views, or utilises the Site in any way which results in any damage, harm, loss or expenses to be suffered by us or the Site, we will hold such person liable for such damage, harm, loss or expenses. Furthermore, in such situation(s), such person(s) agrees to indemnify us against any damage, harm, loss or expenses suffered by us.
10. Limitation of Liability
10.1 In no event will NLC be liable:
10.1.1 to you for any consequences, incidental, consequential or indirect, arising out of the use of or inability to use the Service.
10.1.2 in addition, NLC disclaims all liability, regardless of the form of action, for the acts or omissions of other members or users of the Service.
11. General Provisions
11.1 You agree that this Agreement shall be governed by and construed in accordance with New South Wales Law and you hereby submit to the exclusive jurisdiction of the Courts of New South Wales in relation to any dispute or matter arising out of or connected with this Agreement.
11.2 This Agreement, accepted by you upon registering with or using the Service, contains the entire agreement between you and NLC regarding the use of the Service.
11.3 The invalidity, illegality or unenforceability of any provision of this Agreement shall not affect or impact the continuation in force of the remainder of this Agreement.
12. Communications Policy
12.1 Members may receive NLC regulated e-mails and/or SMS alerts. NLC uses these updates to provide additional savings, special offers, site upgrades, new features, events, promotions, variations of these terms or our policies and more. You have the option to e-mail us to opt out from receiving these e-mails using the link at the bottom of any promotional e-mail you may receive. You also have the option to email us to opt out of receiving the mobile phone messages.
12.2 NLC reserves the right to e-mail you with information essential to your participation in our program including in relation to your compliance with these Terms and Conditions or our policies. You will not have the option to opt-out of e-mails of this nature.
13. Privacy
13.1 All information and details of International Students are stored in a secure database and governed by NLC Privacy Policy;
13.2 Member information and details will be provided to law enforcement authority and emergency services for the purpose of assisting Members during and following safety-related incidents.
13.3 We reserve the right to co-operate fully with any law enforcement authority in any jurisdiction in respect of a lawful direction or request to disclose the identity or other information about anyone posting materials which the authority claims violates any applicable law.
